In this case, premises security expert, Donald J. Decker, CPP, CPM, investigated a matter in which a young woman attending a rock concert sustained injuries when she was struck by another concert patron who had been thrown from the stage by the musician’s security.

Injury at Music Concert – Expert Investigation

A young woman attending a rock concert sustained injuries when she was struck in the head and neck by another concert patron who had been thrown from the stage by the musician’s security. Security for this event was contracted by the concert venue through a third party vendor. Additionally, the musician had his own security personnel. Robson Forensic security expert, Donald J. Decker, CPP, CPM, was retained to determine if the concert venue provided reasonable security for the event, and if the actions of the performer and his security personnel caused this incident.

On the night of the incident, the musician’s head of security removed security personnel from the pit area in front of the stage and allowed more patrons to approach the stage. Additionally, the musician encouraged patrons to come into the pit area. During the concert, audience members from the pit began climbing onto the stage to try to get close to the performer. The musician’s security staff threw a patron from the stage onto a young woman standing in the pit area.

Citing the appropriate standard or care, Mr. Decker demonstrated that the concert venue acted reasonably when they contracted a professional security guard company to provide security at the concert venue. In contrast, the performer and the band’s head of security violated the standard of care for concert security and created a dangerous condition when additional patrons were encouraged to enter the pit area and the musician’s security threw a patron into the audience. The dangerous condition created by the performer and the band’s head of security caused the young woman’s injuries.

This case resolved favorably for our client.
